Rental Agreement
This rental agreement is between My Beach Condos (a division of Camino Management LLC) and , for the rental of . The agreement is for an arrival date of , 2009 after 4 pm and a departure date of , 2009 before 11 am. The rent of $ , $ tax and an $85.00 cleaning fee will be the amount of $ and referred to as total rent. The total rent will be due 30 days prior to occupancy for weekly and nightly occupants. Occupants of 29 days or more see attachment for special terms. There is a refundable security/damage deposit of $300 due at the time of booking. The deposit does not apply to the rent and will be mailed back provided there has been no damage and the condo has been left reasonably clean. Payment is accepted by check, cashier’s check, money order or credit card.
Occupancy: All units are leased without regard to race, color, religion, sex, national origin or handicap. The rental of this unit will be limited to persons. No unit will be rented to persons other adults who are not 25 years of age or older. We will not knowingly contract with anyone under the age of 25 years. Anyone obtaining reservations under false pretenses will be subject to eviction and loss of deposit and rent. All occupants under the age of 25 years must be closely and personally supervised by the renter. If you are evicted for any reason, there will be no refund. It is expressly understood that we shall not be liable for any damage or injury to tenants, their guests or personal property. The property will not be used for any unlawful purposes. It is understood and agreed that owner or their contractors reserves the right to inspect the premises at all reasonable times to ensure maintenance and safety. The owners do not accept responsibility for items left in the unit.
Refunds: Total refund, less 5% on credit card charges if applicable, will only be issued, if cancellation is made, 30 days or more prior to occupancy on weekly or nightly rentals and 60 days or more prior to occupancy on 29 day or more rentals or if owner initiates cancellation. If cancellation is made within 21 days of occupancy only cleaning fee and tax will be refunded or security deposit, whichever is less. However, an exception will be made if we successfully re-rent your unit for the same time period and the original rate. If a mandated evacuation order is issued by the governmental authorities due to a hurricane, a prorated refund will be given to you for the unused portion of your stay. The No Pets rule is strictly enforced by the association. They have the authority to evict, in which case there would be no refund.
Unit Conditions and Damages: Occupants are responsible for any damage they cause to the property and agree to pay all costs for repair of damage and any collection costs. You will be notified of any damage. Occupants will be expected to respect and care for said property. Any condo that is left abnormally or exceptionally dirty, above the normal cleaning, may be subject to additional cleaning fee. Each home is inspected and inventoried on the day of departure. If there is any damage upon your arrival, it is your responsibility to notify us immediately. This unit allows smoking on the balcony only. Should there be evidence of smoking within the unit your $300 damage deposit will be applied towards deep cleaning the unit. Pets in the unit will also void refund of your deposit. We will make every effort to repair any breakdown as soon as possible. We can not guarantee air conditioners, televisions, appliances, etc.
Pool availability is not guaranteed. The internet and cable TV is supplied by the HOA and is not guaranteed. Property Pest control and mandatory or emergency maintenance personnel will try to notify you before entry.
Unit Cleaning and Check-out: The basic (mandatory) cleaning fee covers routine cleaning only, including dusting, sweeping, mopping and laundering linens. Before checking out, you are responsible for lightly cleaning the kitchen, remove all perishables, loading and running the dishwasher and removing all trash. If the cleaning service charges an above normal rate to clean after your departure it will be paid from your security/damage deposit.
Your signature on this agreement affirms your acceptance of the rental of the above property and the terms of this agreement for the above disclosed dates. Signature shall be binding on all persons entering into this agreement and authorizes above charges to credit card. Receipt of this agreement via fax shall also be binding.
